Welcome to COZY. These Terms of Service ("Terms") govern your use of our website, products, and services operated by COZY Foods, Inc. ("COZY," "we," "us," or "our"). By visiting our website, placing an order, creating an account, or using our services, you agree to these Terms.
1. Online Store Terms
By using our website, you confirm that you are at least the age of majority in your state or province of residence, or that you have permission from a parent or legal guardian.
You agree not to use our products, website, or services for any unlawful or unauthorized purpose. You also agree not to interfere with the security, functionality, or operation of our website.
2. Our Products
COZY sells refrigerated snack bars made with real ingredients. Product details, ingredients, allergens, storage guidance, shelf life, pricing, and availability may change at any time.
We do our best to accurately display product information, images, colors, packaging, and descriptions. However, we cannot guarantee that all product details shown on your device will be perfectly accurate. Please review product packaging for the most up-to-date ingredient, allergen, storage, and nutrition information.
3. Food Allergy Notice
Our products may contain or come into contact with allergens, including but not limited to dairy, coconut, oats, and other ingredients. It is your responsibility to review all ingredient and allergen information before consuming our products.
If you have a severe allergy, please contact us before ordering.
4. Orders and Payment
When you place an order, you agree to provide accurate, current, and complete information, including your email address, shipping address, billing address, and payment details.
All prices are listed in U.S. dollars unless otherwise stated. We reserve the right to change prices at any time without notice.
We reserve the right to refuse, cancel, or limit any order for any reason, including suspected fraud, inaccurate product or pricing information, inventory limitations, shipping restrictions, or violation of these Terms.
5. Shipping and Delivery
Because COZY bars are refrigerated, we ship with care to help protect product quality during transit.
We typically ship using a 2-day shipping method and generally ship orders on Mondays and Wednesdays to help ensure your bars arrive fresh. Shipping days and delivery timing may vary based on order volume, holidays, weather, carrier delays, address location, and other factors outside our control.
You will receive a shipping confirmation email with tracking once your order ships.
Under federal rules for online orders, sellers must have a reasonable basis for stated shipping timelines. If no shipping timeline is stated, sellers generally must ship within 30 days. If an order cannot ship within the promised time, the seller must notify the customer and provide the option to consent to the delay or receive a refund.
6. Refrigerated Products and Storage
COZY bars should be refrigerated or frozen after delivery. Please place your bars in the fridge or freezer as soon as possible after receiving them.
Bars may arrive chilled, cool, or partially thawed depending on transit conditions. If your bars arrive cool to the touch and packaging is intact, refrigerate or freeze them and enjoy according to the storage instructions on the package.
We are not responsible for product quality issues caused by improper storage after delivery, delayed pickup, incorrect shipping addresses, unavailable recipients, or packages left outside for extended periods.
7. Returns, Refunds, and Order Issues
Because COZY bars are perishable food items, we do not accept returns.
If your order arrives damaged, incorrect, missing items, or with a quality concern, please contact us within 24 hours of delivery with your order number and clear photos of the issue. We will review the situation and, when appropriate, may offer a replacement, store credit, or refund at our discretion.
We do not guarantee refunds or replacements for issues caused by incorrect shipping information, carrier delays outside our control, failure to retrieve the package promptly, or improper storage after delivery.
8. Subscriptions
If you purchase a COZY subscription, you authorize us to charge your selected payment method on a recurring basis according to the subscription schedule you choose.
You may manage, pause, skip, or cancel your subscription through your account before your next order processes. Changes made after an order has processed may apply to future orders only.
Subscription pricing, products, availability, and shipping rates may change. If required, we will notify you of material changes.
9. Discount Codes and Promotions
Discount codes, referral codes, affiliate codes, and promotions are subject to the terms provided at the time of offer. Promotions may be limited by date, product, order value, customer eligibility, or other conditions.
We reserve the right to modify, suspend, or cancel promotions at any time. Discount codes may not be combined unless stated otherwise.
10. Email, SMS, and RCS Communications
By providing your email address or phone number and opting in, you agree to receive communications from COZY, which may include order updates, shipping notifications, cart reminders, restock alerts, product updates, promotions, and other marketing messages.
Consent to receive marketing messages is not required to make a purchase. Message and data rates may apply. Message frequency may vary.
You may unsubscribe from marketing emails by clicking the unsubscribe link in our emails. You may opt out of SMS or RCS messages by replying STOP, where available, or by following the unsubscribe instructions provided in the message.

11. Account Information
You may create an account to manage orders, subscriptions, and other features. You are responsible for keeping your account login details confidential and for all activity under your account.
Please contact us immediately if you believe your account has been accessed without authorization.
12. Website Content and Intellectual Property
All content on our website, including text, product names, images, graphics, logos, designs, videos, icons, and brand elements, is owned by or licensed to COZY and is protected by intellectual property laws.
You may not copy, reproduce, distribute, modify, sell, or use our content without written permission from COZY.
13. User Content
If you submit reviews, photos, comments, testimonials, social media tags, or other content to COZY, you grant us permission to use, share, reproduce, edit, and display that content for marketing, promotional, and business purposes.
You are responsible for ensuring that any content you submit is accurate, lawful, and does not violate the rights of others.

To the fullest extent permitted by law, COZY Foods, Inc. and its owners, employees, partners, service providers, and affiliates will not be liable for any indirect, incidental, punitive, special, or consequential damages arising from your use of our website, products, or services.
Our total liability for any claim related to an order will not exceed the amount you paid for that order, unless otherwise required by law.

You agree to indemnify and hold harmless COZY Foods, Inc. and its owners, employees, partners, service providers, and affiliates from any claims, damages, losses, liabilities, or expenses arising from your violation of these Terms or misuse of our website, products, or services.

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
20. Mobile Terms of Service

The following Mobile Terms of Service ("Mobile Terms") supplement and form part of the Terms of Service above and apply specifically to COZY's mobile message service.
The COZY mobile message service (the "Service") is operated by COZY ("COZY", "we", or "us"). Your use of the Service constitutes your agreement to these terms and conditions ("Mobile Terms"). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to COZY's SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of COZY through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with COZY. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to +18778651495 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other COZY mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
